Terms of service

These terms apply when you use shishagear.com or buy from us. Please read them before you order.

Age

You must be 18 or over to buy from us. Shisha tobacco is sold only to adults. We use age verification checks, usually on a customer's first order. If we can't verify your age, we may ask for proof of age, and cancel the order if it isn't provided.

Personal use only

Products bought on this website are for your own personal use. You may not:

• resell them, in a shop, online or anywhere else
• use them in a shisha lounge, café, bar or any other business
• call yourself an "authorised dealer", "reseller", "partner" or "distributor" of shishagear or of any brand we sell, or suggest you are connected with us

Businesses, and anyone who needs a VAT invoice, need a trade account. Contact trade@shishagear.com.

Your order

• When you place an order, we email you to confirm we've received it. The contract between us starts when we send your order. Until then, we can decline or cancel an order, for example if an item is out of stock or we can't verify your age or payment.
• We may limit the quantity per customer, and may decline orders that appear to be for resale.
• If you're charged for an order we then cancel, we refund you in full.

Prices and payment

• Prices are in pounds sterling and include UK VAT.
• Delivery is charged separately and shown at checkout.
• If we discover a pricing mistake, we contact you before sending your order. You can then confirm the order at the correct price or cancel it for a full refund.

Products

• We describe and photograph our products as accurately as we can. Colours can look different on different screens, and handmade items such as clay bowls can vary slightly.
• Brand names and logos belong to their owners. Showing them doesn't mean the brand is connected with us.

Delivery, returns and refunds

See our Shipping policy and Refund policy. They form part of these terms.

Our content

• All text, photos, videos, graphics and designs on this website belong to shishagear or our suppliers, and are protected by copyright.
• You may not copy, reproduce or reuse them for any commercial purpose without our written permission. This includes using automated tools to copy our product listings, descriptions, prices or images.

Reviews and comments

• When you post a review or comment, it must be honest, lawful and your own.
• You allow us to show, edit for length and use it, along with the name you give. We don't publish your email address.
• We may remove content that breaks these rules.

Marketing messages

By providing your number and/or email, you agree that Tobi, on behalf of shishagear, may use automated means to send you recurring marketing text messages and emails. Additional messages may be sent based on your interactions with us. We send no more than 5 SMS messages or emails per week. Message and data rates may apply. Reply STOP to unsubscribe, or HELP for help. You can also click the unsubscribe link in any email. For more information, see the SMS marketing privacy policy and SMS terms.

Our responsibility to you

• If we fail to meet these terms, we are responsible for loss or damage you suffer that was a foreseeable result of our failure. We are not responsible for losses that were not foreseeable, or for business losses: our products are for personal use only.
• Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for your legal rights as a consumer.

Complaints

If something has gone wrong, email cs@shishagear.com with "Complaint" at the start of the subject line and your order number. We aim to reply within 1 to 3 working days.

Privacy

How we use your personal information is explained in our Privacy policy.

Changes to these terms

We may update these terms from time to time. The version shown when you place your order is the one that applies to that order.

Law

These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts.
